By creating an account, accessing, or using AutoPost AI, you represent that:

• You have the legal capacity to enter into a binding agreement
• You will comply with these Terms and all applicable laws
• All information you provide is accurate and current

AutoPost AI provides an AI-powered social media management platform that enables users to:

• Create content using artificial intelligence
• Schedule and publish posts to multiple social media platforms
• Manage social media accounts from a centralized dashboard
• Access analytics and engagement metrics

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

3. Account Registration and Security

3.1 Account Creation

To use our service, you must:

• Create an account with accurate information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Restrictions

You may not:

• Share your account with others
• Create multiple accounts to circumvent restrictions
• Use automated means to create accounts
• Impersonate another person or entity

4.1 Content Responsibility

You are solely responsible for all content you create, schedule, and publish through our platform. You agree that your content will not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Contain harmful, offensive, or inappropriate material
• Include spam, scams, or misleading information
• Promote violence, hatred, or discrimination
• Violate the terms of service of connected social media platforms

4.2 Platform Compliance

You must comply with the terms, policies, and guidelines of all social media platforms you connect to AutoPost AI, including but not limited to:

• Facebook/Instagram Terms of Service
• Twitter/X Terms of Service
• LinkedIn User Agreement
• TikTok Terms of Service
• Pinterest Terms of Service

4.3 Prohibited Activities

You may not:

• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use the service for illegal purposes
• Reverse engineer or copy any part of the platform
• Scrape or harvest data from the service
• Circumvent rate limits or usage restrictions
• Resell or redistribute the service without permission

5.1 Balance System

AutoPost AI operates on a prepaid balance system:

• You add funds to your account balance
• Services are charged against your balance as you use them
• Pricing for services is displayed in your dashboard
• You can add funds in increments of your choice

5.2 Payment Processing

All payments are processed securely through Stripe. By adding funds, you:

• Authorize us to charge your payment method
• Agree to provide current and accurate payment information
• Accept responsibility for any fees from your financial institution

5.3 No Refund Policy

Exceptions may be made at our sole discretion in cases of billing errors or technical issues. Contact support@autopostai.app for assistance.

5.4 Pricing Changes

We reserve the right to modify our pricing at any time. Changes will not affect your existing account balance but will apply to future usage. We will provide reasonable notice of significant price changes.

6.1 Our Property

AutoPost AI and all related technology, software, designs, logos, and content are owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our software or content
• Use our trademarks without permission
• Create derivative works based on our platform

6.2 Your Content

You retain all rights to content you create. By using our service, you grant us a limited license to:

• Store and process your content
• Publish your content to connected social media platforms
• Use your content to improve our AI models (anonymized and aggregated)

This license terminates when you delete your content or close your account.

6.3 AI-Generated Content

Content created using our AI tools is provided to you without warranty. You are responsible for reviewing and ensuring all AI-generated content complies with applicable laws and platform policies before publishing.

7. Disclaimer of Warranties and Limitation of Liability

7.1 Service "As Is"

AutoPost AI is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The service will be uninterrupted or error-free
• Content will be published successfully to all platforms
• AI-generated content will meet your expectations
• The service will be compatible with all devices or browsers

7.2 Limitation of Liability

7.3 Third-Party Platforms

We are not responsible for changes, outages, or issues with third-party social media platforms. If a platform modifies its API or policies, we will make reasonable efforts to adapt, but cannot guarantee continued compatibility.

8. Account Termination

8.1 Termination by You

You may close your account at any time through your account settings. Upon closure:

• Your access to the service will be terminated
• Your content will be deleted within 30 days
• Your remaining balance is non-refundable
• Scheduled posts will be canceled

8.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse or misuse the service
• Create risk for us or other users

In case of termination for violation, your remaining balance will be forfeited.

9. Data Protection and Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We are GDPR-compliant and respect your data rights. You may request access, correction, or deletion of your personal data at any time.

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top
• Notify you via email or in-app notification
• Provide at least 30 days notice before changes take effect

Your continued use of the service after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the service.

11. Governing Law and Disputes

These Terms are governed by the laws of Belgium and the European Union. Any disputes will be resolved in the courts of Belgium.

11.2 Dispute Resolution

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutoPost AI.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

12.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

12.4 Assignment

You may not transfer or assign your rights under these Terms. We may assign our rights to any affiliate or successor.
